EVA Air's Claim for NT$34 Million from Flight Attendants' Strike Dismissed by Court

The Taoyuan City Flight Attendant Union initiated a strike against EVA Air in 2019, prompting the airline to file a civil lawsuit seeking NT$34 million in damages from the union and its members. However, both the first and second trial resulted in defeats for EVA Air, and the Supreme Court recently rejected its appeal, confirming the loss.

The case began when the Taoyuan City Flight Attendant Union decided to start the strike process on April 19, 2019, and the strike commenced on June 20 of the same year. EVA Air initiated the lawsuit on June 21, claiming damages due to the union's actions. The Taipei District Court ruled that according to the Labor Dispute Settlement Act, the union’s strike actions were not in violation of good faith principles, thus dismissing EVA Air's claims for damages. The airline appealed, but the Taiwanese High Court upheld the original decision, leading to the Supreme Court's dismissal of EVA Air's appeal and confirming its defeat.
