EVA Air Suffers Defeat in Legal Battle Over Illegal Strike, Union Exempt from Paying 34 Million

The Taoyuan Flight Attendants' Union initiated a strike against EVA Air that lasted for 17 days in 2019. EVA Air claimed the strike was illegal and sought 34 million NTD in damages from the union and 12 union leaders. However, the Taipei District Court ruled in favor of the union, determining that they were not liable for any damages. The High Court upheld this ruling, and the Supreme Court later dismissed EVA Air's appeal, confirming the union's exemption from compensation.

The union had made several demands, including allowances for overseas assignments and a reduction in excessive flight schedules, but after failed negotiations, they officially declared the strike. The court noted that according to labor dispute laws, the union's strike was a legitimate exercise of rights, and employers cannot seek damages for actions that do not violate good faith or the principle of non-abuse of rights.
